As COVID-19 emerged as a phenomenon of the total environment, and despite the intertwined and complex relationships that make humanity an organic part of the Bio- and Geospheres, the majority of our responses to it have been corrective in character, with few or no consideration for unintended consequences which bring about further vulnerability to unanticipated global events. Tackling COVID-19 entails a systemic and precautionary approach to human-nature relations, which we frame as regaining diversity in the Geo-, Bio-, and Anthropospheres. Its (...) implementation requires nothing short of an overhaul in the way we interact with and build knowledge from natural and social environments. Hence, we discuss the urgency of shifting from current to precautionary approaches to COVID-19 and look, through the lens of diversity, at the anticipated benefits in four systems crucially affecting and affected by the pandemic: health, land, knowledge and innovation. Our reflections offer a glimpse of the sort of changes needed, from pursuing planetary health and creating more harmonious forms of land use to providing a multi-level platform for other ways of knowing/understanding and turning innovation into a source of global public goods. These exemplary initiatives introduce and solidify systemic thinking in policymaking and move priorities from reaction-based strategies to precautionary frameworks. (shrink)

The moral justification of intellectual property is often called into question when placed in the context of pharmaceutical patents and global health concerns. The theoretical accounts of both John Rawls and Robert Nozick provide an excellent ethical framework from which such questions can be clarified. While Nozick upholds an individuals right to intellectual property, based upon its conformation with Lockean notions of property and Nozicks ideas of just acquisition and transfer, Rawls emphasizes the importance of basic liberties, such as an (...) individuals right to health, superceding such secondary rights as intellectual property rights. From a policy perspective, patent protection for pharmaceutical products necessarily entails the balancing of corporate intellectual property interests and public interests in healthcare. The moral dilemma that occurs when these two interests clash is not easily resolved. Aside from corporate and public interests, the state maintains an interest in creating and preserving policies that regulate the moral dilemma itself. This paper analyzes the economic and ethical factors surrounding the production and distribution of the anti-HIV medication, AZT. Potential policy implications and recommendations are also discussed. In this essay I revise, based on the notion of the ‘enlightened ruler’ or mingzhu and his critique of the literati of his time, the common belief that Han Fei was an amoralist and an advocate of tyranny. Instead, I will argue that his writings are dedicated to advising those who ought to rule in order to achieve the goal of a peaceful and stable society framed by laws in accordance with the dao.

Many think that expressivists have a special problem with negation. I disagree. For if there is a problem with negation, I argue, it is a problem shared by those who accept some plausible claims about the nature of intentionality. Whether there is any special problem for expressivists turns, I will argue, on whether facts about what truth-conditions beliefs have can explain facts about basic inferential relations among those beliefs. And I will suggest that the answer to this last question is, (...) on most plausible attempts at solving the problem of intentionality, ‘no’. (shrink)

The literary genesis of Einbahnstraße by Walter Benjamin represents a very special case of the use of the procedures of surrealism in the philosophical-literary production of the author. The process of evolution of thinking that ended up in the writing of this piece is unveiled throughout the present analysis. This is a sign of both waiver and restart; the opening for a new productive dimension in the career of one of the most important —and misunderstood— philosophers of the 20th century. (...) More than enlightening a small master piece of philosophy from a literary perspective, or analyzing a small master piece of literature from the philosophy, what is being problematized here is the division, cultivated or figured throughout the years, between both disciplines. On a view implicitly endorsed by many, a concept is epistemically better than another if and because it does a better job at ‘carving at the joints', or if the property corresponding to it is ‘more natural' than the one corresponding to another. This chapter offers an argument against this seemingly plausible thought, starting from three key observations about the way we use and evaluate concepts from en epistemic perspective: that we look for concepts that play a role in explanations (...) of things that cry out for explanation; that we evaluate not only ‘empirical' concepts, but also mathematical and perhaps moral concepts from an epistemic perspective; and that there is much more complexity to the concept/property relation than the natural thought seems to presuppose. Epistemic Utility Theory is often identified with the project of *axiology-first epistemology*—the project of vindicating norms of epistemic rationality purely in terms of epistemic value. One of the central goals of axiology-first epistemology is to provide a justification of the central norm of Bayesian epistemology, Probabilism. The first part of this paper presents a new challenge to axiology first epistemology: I argue that in order to justify Probabilism in purely axiological terms, proponents of axiology first epistemology need to justify a (...) claim about epistemic value—what I label ‘Downwards Propriety’—much stronger than any they have offered justification. The second part of this paper offers an argument that this challenge cannot be met: that there is no hope for providing a purely axiological justification of Downwards Propriety, at least given widely accepted assumptions about epistemic value. Epistemic rationality is typically taken to be immodest at least in this sense: a rational epistemic state should always take itself to be doing at least as well, epistemically and by its own light, than any alternative epistemic state. If epistemic states are probability functions and their alternatives are other probability functions defined over the same collection of proposition, we can capture the relevant sense of immodesty by claiming that epistemic utility functions are (strictly) proper. In this paper I examine (...) what happens if we allow for the alternatives to an epistemic state to include probability functions with different domains. I first prove an impossibility result: on minimal assumptions, I show that there is no way of vindicating strong immodesty principles to the effect that any probability function should take itself to be doing at least as well than any alternative probability function, regardless of its domain. I then consider alternative, weaker generalizations of the traditional immodesty principle and prove some characterization results for some classes of epistemic utility functions satisfying each of the relevant principles. Proponents of enactivism should be interested in exploring what notion of action best captures the type of action-perception link that the view proposes, such that it covers all the aspects in which our doings constitute and are constituted by our perceiving. This article proposes and defends the thesis that the notion of sensorimotor dependencies is insufficient to account for the reality of human perception, and that the central enactive notion should be that of perceptual practices. Sensorimotor enactivism is insufficient because (...) it has no traction on socially dependent perceptions, which are essential to the role and significance of perception in our lives. Since the social dimension is a central desideratum in a theory of human perception, enactivism needs a notion that accounts for such an aspect. This article sketches the main features of the Wittgenstein-inspired notion of perceptual practices as the central notion to understand perception. Perception, I claim, is properly understood as woven into a type of social practices that includes food, dance, dress, music, etc. More specifically, perceptual practices are the enactment of culturally structured, normatively rich techniques of commerce of meaningful multi- and inter-modal perceptible material. I argue that perceptual practices explain three central features of socially dependent perception: attentional focus, aspects’ saliency, and modal-specific harmony-like relations. (shrink)

Teacher quality, its effect on students’ outcomes, and the association of these with economic growth, is the core of recent discussions in Latin America given the region’s weak results in international learning assessments. This paper investigates whether there is an effect of philosophy on the outcomes of critical reading for students in B.Ed. programs in Colombia. Relying on exact matching combined with propensity score matching with regression adjustment, we use national data from Colombia to show that students in B.Ed. in (...) philosophy outperformed students in other B.Ed. in critical reading test (0.401–0.124 SD), and, importantly, with higher effects observed for students with lower prior academic achievement (0.44 SD). This suggests that philosophy can help to narrow educational outcomes of students whose socioeconomic conditions are disadvantageous, contributing to social justice in education. (shrink)

It is commonly accepted that Han Fei studied under Xunzi sometime during the late third century BCE. However, there is surprisingly little dedicated to the in-depth study of the relationship between Xunzi’s ideas and one of his best-known followers. In this essay I argue that Han Fei’s notion of xing, commonly translated as human nature, was not only influenced by Xunzi but also that it is an important feature of his political philosophy.

El texto pretende aportar una reflexión en torno a dos categorías teórico-prácticas –regionalidad, populismo–, que pueden contribuir a la proyección abierta, nunca acabada, de un nuevo orden post-neoliberal, en tanto modos de resistencia y crítica de los modos de subjetivación y de mercantilización que identificamos como propios del neoliberalismo en tanto racionalidad, pero también posibilitadoras de un pensar situado, propositivo, comprometido políticamente con el lugar desde donde se entiende y se proyecta un nuevo orden de convivencia.

This paper discusses the logical space of alternative conceptual engineering projects, with a specific focus on (1) the processes, (2) the targets and goals, and (3) the methods of such projects. We present an overview of how these three aspects interact in the contemporary literature and discuss those alternative projects that have yet to be explored based on our suggested typology. We show how choices about each element in a conceptual engineering project constrain the possibilities for the others, thereby giving (...) rise to distinct groupings of possible projects under the banner of conceptual engineering. We conclude with a critical reflection on the potential ethical issues that arise as a result of effectively putting conceptual engineering into practice. (shrink)

This book is conceived as an introductory text into the theory of syntactic and semantic information, and information flow.

Conceptual engineering means to provide a method to assess and improve our concepts working as cognitive devices. But conceptual engineering still lacks an account of what concepts are (as cognitive devices) and of what engineering is (in the case of cognition). And without such prior understanding of its subject matter, or so it is claimed here, conceptual engineering is bound to remain useless, merely operating as a piecemeal approach, with no overall grip on its target domain. The purpose of this (...) programmatic paper is to overcome this knowledge gap by providing some guidelines for developing the theories of concepts and of cognition that will ground the systematic unified framework needed to effectively implement conceptual engineering as a widely applicable method for the cognitive optimization of our conceptual devices. This paper critically explores the ethical dimensions of Behavioral Public Policy (BPP), a domain grounded in the understanding that human rationality is bounded and that this limitation often leads to behaviors deemed irrational. By applying the behavioral lens, which posits that people operate under bounded rationality, BPP aims to craft interventions that safeguard individuals against their biases. However, this approach raises significant ethical concerns, both in the scientific underpinnings of BPP and its application through policy interventions. Accordingly, this paper examines (...) two distinct ethical dimensions of BPP, both as a scientific discipline and through its intervention methodologies. The analysis of the first dimension argues that, viewing bounded rationality as only instrumental in decision-making processes, risks oversimplifying ethical complexities. Such simplification may ignore the moral and value-based rationalities underlying decisions, potentially misattributing instances of immorality and akrasia (the failure to act according to one's judgment) to mere deficiencies in rational thinking. Secondly, the paper examines the impact of BPP on moral behavior and character development, addressing ethical concerns like the evidentiary basis of BPP research, the bounded rationality of choice architects themselves, and the morality of behavior changes induced by policy. Overall, this article provides a much-needed examination of the moral considerations associated with behavioral strategies in public policy and its epistemological foundations, contributing to a more comprehensive understanding of their ethical implications . Conceptual engineering is the method for assessing and improving our concepts. However, little has been written about how best to conceive of concepts for the purposes of conceptual engineering. In this paper, I aim to fill this foundational gap, proceeding in three main steps: First, I propose a methodological framework for evaluating the conduciveness of a given concept of concept for conceptual engineering. Then, I develop a typology that contrasts two competing concepts of concept that can be used in conceptual (...) engineering — namely, the philosophical and psychological ones. Finally, I evaluate these two concepts of concept using the proposed methodological framework and I show that, when it comes to making conceptual engineering an actionable method, the psychological concept of concept outclasses its philosophical counterpart on all counts. This provides a baseline from which the concept of concept can be further improved for the purposes of conceptual engineering. (shrink)

The central aim of the present investigation is to shed light on Nietzsche’s understanding of happiness and a good life, starting from Nietzsche’s appropriation of Plato’s and Aristotle’s doctrine of a hierarchy of human beings and forms of life.

I argue that Husserl’s concept of position-taking, Stellungnahme, is adequate to understand the idea of second nature as an issue of philosophical anthropology. I claim that the methodological focus must be the living subject that acts and lives among others, and that the notion of second nature must respond to precisely this fundamental active character of subjectivity. The appropriate concept should satisfy two additional desiderata. First, it should be able to develop alongside the biological, psychological, and social individual development. Second, (...) it should be able to underlie the vast diversity of human beings within and across communities. As possible candidates, I contrast position-taking with two types of habit-like concepts: instinct and habitus, on the one hand, and customary habits, on the other. I argue that position-taking represents the active aspect of the subject while the habit-like concepts are passive. A subject’s position-takings and ensuing comportments are tied together by motivations, which evince a certain consistency, and for this reason are expression of the subject’s identity. I conclude by nuancing the relation between Stellungnahme and passivity. Passivity is deemed necessary to action but subservient to it; position-taking is thought to be prior to passivity. (shrink)

The paper argues against a commitment to metaphysical necessity, semantic modalities are enough. The best approaches to elucidate the semantic modalities are (still) versions of lingustic ersatzism and fictionalism, even if only developed in parts. Within these necessary properties and the difference between natural and semantic laws can be accounted for. The proper background theory for this is an updated version of Logical Empiricism, which is congenial to recent trends in Structural Realism. The anti-metaphysical attitude of Logical Empiricism deserves revitalization. (...) Since the concept of “nudge” was introduced in 2008 by Thaler and Sunstein, proposing that small interventions based on changes in choice architectures can alter people’s behavior and make it easier for them to achieve their desired goals, the application in public policy of behavioral economics has gained significant attention. This has led to the emergence of different types of policies based on behavioral insights, which have been used in a variety of areas, including health or finance, with the goal (...) of promoting well-being and addressing social and economic issues. After providing a basic theoretical background as a frame of reference to understand gender violence, this study explores the use of tools from the field of behavioral economics as it is applied in public policy. Regulatory (paternalistic) and non-regulatory (libertarian) interventions based on behavioral insights will be considered: nudges, boosts, shoves, budges, or sludge audits, are examined as potential interventions to use in matters related to this type of violence. After evaluating these behavioral policy instruments and their potential effectiveness, the limitations of the behavioral perspective are recognized, and the need for a multifaceted approach to combating gender violence is acknowledged. The article concludes by arguing that public policies addressing gender violence should not only utilize behavioral tools but should also incorporate strategies related to education, legislation, and social norms. A modified visual search task demonstrates that humans are very good at resuming a search after it has been momentarily interrupted. This is shown by exceptionally rapid response time to a display that reappears after a brief interruption, even when an entirely different visual display is seen during the interruption and two different visual searches are performed simultaneously. This rapid resumption depends on the stability of the visual scene and is not due to display or response anticipations. These results are (...) consistent with the existence of an iterative hypothesis-testing mechanism that compares information stored in short-term memory (the perceptual hypothesis) with information about the display (the sensory pattern). In this view, rapid resumption occurs because a hypothesis based on a previous glance of the scene can be tested very rapidly in a subsequent glance, given that the initial hypothesis-generation step has already been performed. Intellectual progress involves forming a more accurate picture of the world. But it also figuring out which concepts to use for theorizing about the world. Bayesian epistemology has had much to say about the former aspect of our cognitive lives, but little if at all about the latter. I outline a framework for formulating questions about conceptual change in a broadly Bayesian framework. By enriching the resources of Epistemic Utility Theory with a more expansive conception of epistemic value, I offer (...) a picture of our cognitive economy on which adopting new conceptual tools can sometimes be epistemically rational. Desde que en 2008 se introdujera el concepto de nudge en el libro Nudge, que argumentaba que las pequeñas intervenciones basadas en cambios en la arquitectura de elección pueden alterar el comportamiento de las personas y facilitarles el logro de sus objetivos deseados, el uso de la economía del comportamiento en políticas públicas ha crecido significativamente, lo que ha llevado a la aparición de diferentes intervenciones basadas en conocimientos conductuales. Estas intervenciones se han aplicado en distintas áreas de políticas públicas (...) y administrativas, incluyendo salud, finanzas, o medio ambiente, con el objetivo de promover el bienestar y abordar problemas sociales y económicos. El uso de estas aplicaciones en cuestiones relacionadas con la violencia de género ha sido con frecuencia ignorado. De este modo, el objetivo de este estudio es analizar el uso de herramientas de la economía del comportamiento en políticas públicas, como nudges, boosts o auditoría de sludges y su aplicación a asuntos relacionados con este tipo de violencia. Al mismo tiempo que se señalan los posibles beneficios de su uso, también se reconocen las limitaciones del enfoque conductual, apuntando a la necesidad de una aproximación multifacética para combatir dicha violencia. Qu’est-ce que la théologie analytique ? Que veut la théologie analytique et que pouvons-nous attendre d’elle ? Ces questions semblent constituer le défi d’aujourd’hui pour la théologie analytique. Nous répondrons à ces questions, en proposant de la distinguer des autres disciplines avec lesquelles elle semble se confondre. Cette recherche nous conduira d’abord à proposer une nouvelle définition de la théologie analytique fondée sur trois critères et par la suite à distinguer deux manières de faire la théologie analytique: (i) une théologie (...) analytique de bas en haut et (ii) une théologie analytique de haut en bas. Definitions of terms that are central to a theoretical understanding of the Royal Government of Bhutan's policy of Gross National Happiness.

The Enhanced Indispensability Argument appeals to the existence of Mathematical Explanations of Physical Phenomena to justify mathematical Platonism, following the principle of Inference to the Best Explanation. In this paper, I examine one example of a MEPP—the explanation of the 13-year and 17-year life cycle of magicicadas—and argue that this case cannot be used defend the EIA. I then generalize my analysis of the cicada case to other MEPPs, and show that these explanations rely on what I will call ‘optimal (...) representations’, which are representations that capture all that is relevant to explain a physical phenomenon at a specified level of description. In the end, because the role of mathematics in MEPPs is ultimately representational, they cannot be used to support mathematical Platonism. I finish the paper by addressing the claim, advanced by many EIA defendants, that quantification over mathematical objects results in explanations that have more theoretical virtues, especially that they are more general and modally stronger than alternative explanations. I will show that the EIA cannot be successfully defended by appealing to these notions. (shrink)

Conceptual engineering is the method for assessing and improving our concepts. Some have recently claimed that the implementation of such method in the form of ameliorative projects is truth-driven and should thus be epistemically constrained, ultimately at least (Simion 2018; cf. Podosky 2018). This paper challenges that claim on the assumption of a social constructionist analysis of ideologies, and provides an alternative, pragmatic and cognitive framework for determining the legitimacy of ameliorative conceptual projects overall. This paper presents an impact evaluation of the policies for teacher education programs within the framework of the National Development Plan 2014-2018. The programs were compelled to obtain high-quality accreditation, increase the credits in school practices, and the English level, among other requirements. Relying on multivariable regression, it shows that, for the year 2021, there is no association between high-quality accreditation in most modules of the Saber Pro tests, or it is negative in the global score and quantitative reasoning. In (...) a second step, using Differences–in–Differences, it evidences how the changes made by the programs had positive effects on the performance of students compared to other professional programs. The results show significant improvement in most modules of the Saber Pro test, except for the English module. The effects were homogeneous by characteristics of the students and institutions, but heterogeneous by area of knowledge, indicating that the effect is mainly due to the curricular changes of the programs. In David Hume’s A Treatise of Human Nature, reason and passion are in constant interaction forming belief. Moral events are distinguished on three levels: moral sentiment, moral action and moral judgment, in which reason and passion interact, although with different functions at each level.

This article covers the different stages of the constitution of the person that goes beyond selfishness and self-affirmation and is formed as the inseparable unity of the metaphysical subject that is expressed in the "Other-in-the same" and "Being-for-the-other". This leads one to say that the person is intrinsically relation and exteriority that is realized in the language that transcends the inner self. This relationship, considered internally as a footprint, and in the exterior as visage, invokes a third party that establishes (...) and holds it. The person is shown as an asymmetrical relationship that I call triadic. (shrink)

In this paper I defend an intermediate position between the ‘bare mathematical results’ view and the ‘transmission’ view of mathematical explanations of physical phenomena (MEPPs). I argue that, in MEPPs, it is not enough to deduce the explanandum from the generalizations cited in the explanans. Rather, we must add information regarding why those generalizations obtain. However, I also argue that it is not necessary to provide explanatory proofs of the mathematical theorems that represent those generalizations. The bridges of Königsberg case has been widely cited in recent philosophical discussions on scientific explanation as a potential example of a structural explanation of a physical phenomenon. However, when discussing this case, different authors have focused on two different versions, depending on what they take the explanandum to be. In one version, the explanandum is the _failure_ of a given individual in performing an Eulerian walk over the bridge system. In the other version, the explanandum is the _impossibility_ of (...) performing an Eulerian walk over the bridges. The goal of this paper is to show that only the latter version amounts to a real case of a structural explanation. I will also suggest how to fix the first version, and show how my remarks apply to other purported cases of structural explanations. (shrink)

Conceptual engineering is the method for assessing and improving our representational devices. On its ‘broad-spectrum’ version, it is expected to be appropriately applicable to any of our representation-involving cognitive activities, with major consequences for our whole cognitive life. This paper is about the theoretical foundations of conceptual engineering thus characterised. With a view to ensuring the actionability of conceptual engineering as a broad-spectrum method, it addresses the issue of how best to construe the subject matter of conceptual engineering and successively (...) defends the theses that conceptual engineering should be: (i) About concepts, (ii) psychologically theorised, (iii) as multiply realised functional kinds. Thereby, I claim to theoretically secure and justify the maximum scope, flexibility, and impact for the method of conceptual engineering on our representational devices in our whole cognitive life—in other words, a broad-spectrum version of conceptual engineering. The following considerations concern modelling Belief Dynamics (BD) not just in the sense of a formalization, but rather in the sense of building a computational model and implementing the corresponding data structures and algorithms of recomputing beliefs. The purpose of such a project is to illustrate some ideas about belief changes in a Web of Beliefs (WoB) to explore and deepen one's understanding of belief changes by trying to implement or improve corresponding algorithms.

In this paper we discuss the extent to which the very existence of substructural logics puts the Tarskian conception of logical systems in jeopardy. In order to do this, we highlight the importance of the presence of different levels of entailment in a given logic, looking not only at inferences between collections of formulae but also at inferences between collections of inferences—and more. We discuss appropriate refinements or modifications of the usual Tarskian identity criterion for logical systems, and propose an (...) alternative of our own. After that, we consider a number of objections to our account and evaluate a substantially different approach to the same problem. (shrink)

What is a philosophy class like? What roles do teachers and students play? Questions like these have been answered time and again by philosophers using images and metaphors. As philosophers continue to develop pedagogical approaches in a more conscious way, it is worth evaluating traditional metaphors used to understand and structure philosophy classes. In this article, we examine two common metaphors—the sage on the stage, and philosophy as combat—and show why they fail pedagogically. Then we propose five metaphors—teaching philosophy as (...) world-traveling, wondering, conducting an orchestra, storytelling, and coaching—that can better respond to the needs of increasingly diverse student bodies. Further, these metaphors find their ground in long-standing beliefs about what philosophy is, how it is done, and what it can do for those willing to engage in it. While no single one of them is comprehensive, we think that these models can help us enliven our own thinking about our teaching and the roles we and our students play in our classrooms. (shrink)

Die Forschung hat bislang entweder bemängelt, dass Nietzsches Philosophie ein Begriff von szialer Gerechtigkeit fehlt oder had einen solchen kaum in den Blick bekommen. Im Gegensatz dazu argumentiert der Aufsatz dafür, dass der sozialen Gerechtigkeit in Nietzsches politischem Denken eine zentrale Rolle zukommt. Er zeigt, dass das antike Vorbild seiner Gerechtigkeitsauffasseng Platons Begriff der politischen Gerechrigkeit ist. On the contrary, the essay argues that social justice plays an important role in Nietzsche's political thinking. It shows that his conception of justice is modelled after Plato's antique concept of political justice. The main thesis of the essay is that this conception is embodied in Nietzsche's notion of a well-ordered state or society. An additional thesis concerns the anthropological basis of what Nietzsche holds to be a just social order. Philosophers disagree whether composition as identity entails mereological universalism. Bricker :264–294, 2016) has recently considered an argument which concludes that composition as identity supports universalism. The key step in this argument is the thesis that any objects are identical to some object, which Bricker justifies with the principle of the universality of identity. I will spell out this principle in more detail and argue that it has an unexpected consequence. La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

In this article, we will present a number of technical results concerning Classical Logic, ST and related systems. Our main contribution consists in offering a novel identity criterion for logics in general and, therefore, for Classical Logic. In particular, we will firstly generalize the ST phenomenon, thereby obtaining a recursively defined hierarchy of strict-tolerant systems. Secondly, we will prove that the logics in this hierarchy are progressively more classical, although not entirely classical. We will claim that a logic is to (...) be identified with an infinite sequence of consequence relations holding between increasingly complex relata: formulae, inferences, metainferences, and so on. As a result, the present proposal allows not only to differentiate Classical Logic from ST, but also from other systems sharing with it their valid metainferences. Finally, we show how these results have interesting consequences for some topics in the philosophical logic literature, among them for the debate around Logical Pluralism. The reason being that the discussion concerning this topic is usually carried out employing a rivalry criterion for logics that will need to be modified in light of the present investigation, according to which two logics can be non-identical even if they share the same valid inferences. When discussing Logical Pluralism several critics argue that such an open-minded position is untenable. The key to this conclusion is that, given a number of widely accepted assumptions, the pluralist view collapses into Logical Monism. In this paper we show that the arguments usually employed to arrive at this conclusion do not work. The main reason for this is the existence of certain substructural logics which have the same set of valid inferences as Classical Logic—although they are, in a clear (...) sense, non-identical to it. We argue that this phenomenon can be generalized, given the existence of logics which coincide with Classical Logic regarding a number of metainferential levels—although they are, again, clearly different systems. We claim this highlights the need to arrive at a more refined version of the Collapse Argument, which we discuss at the end of the paper. (shrink)

What would happen if one morning you wake up clumsy, as if your sense of touch were unreliable, arbitrarily on and off? And what would this clumsiness look like if we could transfer it to the moral sense? The article expounds an interesting analogy between the sense of touch, loosely construed, and the moral sense: just as a sort of consistency is necessary for the sense of touch to do its job, so it is for the moral sense to play (...) its part. Touch enables us to navigate the everyday world of coffee pots and staircases; our moral sensibility comes into play when we act or when we judge our actions and those of others, and plays a directive role in what we feel, how we feel it, and how we react to it. Taking the analogy further, I will suggest that inconsistency causes, in both cases, a certain clumsiness, and that clumsiness is linked to arbitrariness – like the person that helps others in dire need, but only does so on some rainy days. Esta tradición se remonta a Teognis, Heráclito y Platón y se inicia como una crítica dirigida tanto a la decadencia de la virtud aristocrática como cuanto al ascenso de valores democráticos ey egalitariosigualitarios. Este ensayo trabajo demuestra que Aristóteles concibe las diferentes formas de constitución como manifestaciones de distintas concepciones de la justicia distributiva. Aristóteles mantiene una clara preferencia por una concepción aristocrática de la justicia, y , por tantocomo consecuencia, por la aristocracia. La constitución de la mejor polis ideal que detalla en los libros VII y VIII de la Política debe entenderse como una “verdadera aristocracia” en la que los cargos políticos son distribuidos, según el mérito (κατ᾽ ἀξίαν), a los mejores ciudadanos entre los ciudadanos que sean los mejores desde el punto de vista moral e intelectualtanto moral como intelectualmente hablando. Although vaccines are considered an efficient public health tool by medical experts, in different countries, people’s confidence in them has been decreasing. COVID-19 has elevated medical scientists’ and practitioners’ social reputation, and it may have reduced global vaccination hesitancy. Still, this alone will not altogether remove the existent frictions that prevent people from complying with vaccination schedules. This paper will review the common causes behind vaccination hesitancy. It will also explore different types of public policy interventions that health experts in (...) governments and institutions employ to fight vaccine hesitancy and non-compliance. The main objective of this article is to argue that, considering the nature of the issue (vaccine hesitancy and its causes), among the various possibilities, policies based on behavioral insights can provide an effective instrument to remove those frictions. Among them, special attention will be devoted to nudges which promise efficiency while avoiding some of the ethical and political costs of other interventions, thanks to their libertarian paternalistic frame. The article concludes by suggesting that public health policymakers should consider the libertarian paternalistic approach of nudges when deploying interventions that aim at changing people’s attitudes and behavior. Political fact-checkers evaluate the truthfulness of politicians’ claims. This paper contributes to an emerging scholarly debate on whether fact-checkers treat political parties differently in a systematic manner depending on their ideology (bias). We first examine the available approaches to analyze bias and then present a new approach in two steps. First, we propose a logistic regression model to analyze the outcomes of fact-checks and calculate how likely each political party will obtain a truth score. We test our model with a (...) sample of fact-checks from Newtral, a major Spanish fact-checker. Our model would signal bias under two assumptions: a) all political parties are on average equally accurate in their statements; b) the verification method gives precise instructions and is implemented systematically. We investigate this second assumption with a series of interviews with Newtral fact-checkers. We show that standard verification protocols are so loosely implemented that fact-checks reflect a set of journalistic decisions, rather than a bias in the statistical sense. We call for a more rigorous definition of verification methods as a pre-requisite for an unbiased assessment of politician’s claims. (shrink)
